How are pleas negotiated between attorneys? Well, first of all, the judge is not involved in this plea negotiation process. The plea agreements that are reached take place between your attorney and the prosecutor who is assigned to the case. The negotiations usually take place at the day of court, rather than well in advance of your court date. Certainly, it would be easier on you to have this done or accomplished before your day in court. But the reality of it is, that the prosecutor has not had an opportunity to speak with the arresting officer until the day of court and will not be in the final position to make the final decision until that day.
