Virginia DUI Second Offense
A second DUI offense means that you have been convicted of at least two DUIs within a 5- to 10-year time period. The minimum fine will be $500 and the maximum fine is $2500. Other penalties are determined by your blood alcohol content level. If you were between .08 and .14, you will be sentenced to a minimum 1-month jail term. The mandatory minimum that must be served is 20 days. If this is your second DUI within a 10-year time period, you must serve a 10-day jail sentence. For a BAC of .21 or more, you will be sentenced to an additional mandatory minimum of 20 days, resulting in a 40-day total jail term.
If convicted of a second DUI offense, your license will be suspended for 3 years. Following 12 months, you may receive a restricted license in order to get to work, school or to receive medical attention. However, you must have an ignition interlock system installed in your vehicle. If you are caught tampering with this machine, you can be sent back to jail and ordered to pay a heavy fine. You will also be charged with a Class I misdemeanor.
