In the unfortunate event that you’re facing a third DUI offense within a 10-year period, you will be charged with a felony if convicted. The jail term you could receive may range from 1 to 5 years, but the minimum sentence is 90 days. If this is your third DUI offense within 5 years of the previous two, you must spend at least 6 months in jail.


The minimum fine you will receive is $1,000. As far as your license is concerned, it will be taken away indefinitely. You will not be able to apply for a restricted license until 3 years after your conviction date. Even then you will be required to petition the court and have a restoration hearing. If after three years you receive a restricted license, the judge will most likely order an ignition interlock system to be installed for at least 6 months.
